   1. The App is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, as to the operation of the App or the information, content, materials, or products included on the App.
   2. We do not warrant that the App will be uninterrupted or error-free, and we will not be liable for any interruptions or errors.
   3. We do not warrant that the App or any content or information provided through the App will be accurate, reliable, or complete. We do not endorse any opinions expressed through the App.
   4. We do not warrant that the App will be free from viruses or other harmful code. You are responsible for implementing appropriate security measures to protect your device and data from viruses and other harmful code.
3. Limitation of Liability
   1. We will not be liable for any damages of any kind arising from the use of the App, including but not limited to direct, indirect, incidental, punitive, and consequential damages.
   2. We will not be liable for any loss of profits, loss of business, or other financial loss arising from the use of the App.
   3. We will not be liable for any damages resulting from the loss of use, data, or profits, or from any unauthorized access to or alteration of your transmissions or data.
   4. We will not be liable for any damages resulting from the conduct of any third party on the App, including but not limited to any defamatory, offensive, or illegal conduct.
4. Indemnification

   You agree to indemnify and hold us and our affiliates, officers, agents, and employees harmless from any claim or demand from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the App, your violation of the Terms, or your violation of any rights of another.

   This means that if a third party makes a claim or demand against us as a result of your actions, you will be required to compensate us for any damages or costs incurred as a result of the claim or demand. You are also required to defend us and our affiliates, officers, agents, and employees against any such claims or demands. This provision is intended to protect us and our affiliates, officers, agents, and employees from any legal liability that may arise as a result of your use of the App.

5. Governing Law

   The seller of an algorithmic stock trading strategy (the "Strategy") provides the Strategy to you on an "as is" basis and makes no representations or warranties of any kind, express or implied, with respect to the Strategy, including without limitation, any warranty of merchantability or fitness for a particular purpose. The seller shall not be liable for any direct, indirect, incidental, consequential or punitive damages arising out of or in connection with the use or inability to use the Strategy, or any errors or omissions in the Strategy, even if the seller has been advised of the possibility of such damages. By using the Strategy, you acknowledge that you understand and agree to assume the risk of any and all losses or malfunctions that may occur as a result of using the Strategy. You also agree to indemnify and hold the seller harmless from any and all claims, damages, losses, and expenses, including attorneys' fees, arising out of or in connection with your use of the Strategy. This legal notice is subject to change at any time, and it is your responsibility to review it periodically for any updates or changes. Your continued use of the Strategy after any updates or changes to this legal notice shall constitute your acceptance of such updates or changes.

8. Termination

   We reserve the right to terminate your access to the App at any time, without notice, for any reason, including but not limited to a breach of the Terms. A refund will not be processed unless extreme circumstances occur on our end which prevented your use of the software.

9. Entire Agreement

   The Terms constitute the entire agreement between you and us and govern your use of the App, superseding any prior agreements between you and us (including, but not limited to, any prior versions of the Terms).

10. Waiver and Severability

    Our failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and that the other provisions of the Terms remain in full force and effect.

    This means that if any part of the Terms is found to be invalid or unenforceable, the court will try to interpret the provision in a way that is consistent with the parties' intentions. The other provisions of the Terms will remain in full force and effect. This provision is intended to ensure that the Terms as a whole remain valid and enforceable, even if one provision is found to be invalid or unenforceable.

11. Changes to the Terms

    We reserve the right to update and change the Terms from time to time without notice. Any new features that augment or enhance the current App, including the release of new tools and resources, shall be subject to the Terms. Continued use of the App after any such changes shall constitute your consent to such changes.
